Key Takeaways
You normally have only three weeks from receipt of the signed termination letter to file a dismissal protection claim.
The German Protection Against Dismissal Act (Kündigungsschutzgesetz, KSchG) generally applies after more than six months of employment in a business with more than ten qualifying employees.
A dismissal must be delivered on paper with an original handwritten signature. Email, DocuSign, a scan or WhatsApp is not enough.
Do not sign a separation agreement (Aufhebungsvertrag) before its effects on severance, unemployment benefits and your residence status have been checked.
Register as a jobseeker on time. If your residence permit is tied to your job, a separate two-week notification duty may also apply.
There is no general automatic right to severance, but it can result from § 1a KSchG, a settlement or another specific legal basis.
An Unfair dismissal in Germany does not have to be accepted simply because the letter looks official. German law sets rules for the form, timing and justification of a termination. For expats, the situation can feel especially urgent because employment, health insurance, unemployment benefits and residence status may all seem connected.
They are connected in practice, but they follow different rules and deadlines. This guide helps you separate them and protect your options step by step.
Your first move is simple: record when the original letter reached you, keep the envelope, and do not let discussions with HR distract you from the three-week court deadline.
What should you do in the first 72 hours?
Secure the dates, documents and deadlines before you negotiate anything. Photograph or scan the letter and envelope. Collect your employment contract, amendments, recent payslips, bonus rules, warnings, performance reviews and relevant messages. Write down who delivered the letter, when it entered your mailbox and whether anyone witnessed delivery.
Deadline: three weeks from receipt
Under § 4 KSchG, a dismissal protection claim (Kündigungsschutzklage) generally has to reach the Labour Court within three weeks after you receive the written dismissal. If you do not challenge it in time, § 7 KSchG normally treats it as valid from the outset. The exceptions in § 5 KSchG are narrow.
Register as a jobseeker (arbeitssuchend) even if you plan to sue. If you know the end date at least three months in advance, register no later than three months before it. If you learn of the end later, register within three days of learning the date. This duty continues while a court challenge is pending.
§ 38(1) SGB III: Jobseeker registration
Register no later than three months before employment ends; if less than three months remain, register within three days of learning the end date.
Practical tip
Ask for a qualified reference (qualifiziertes Arbeitszeugnis). Under § 109 GewO, you can request a written reference covering both your work and conduct when employment ends.
When does the Kündigungsschutzgesetz protect you?
The KSchG generally protects you once you have worked for more than six uninterrupted months and the business regularly employs more than ten qualifying employees.
Part-time employees are weighted at 0.5 or 0.75 under § 23 KSchG, depending on weekly hours; vocational trainees are excluded. Special transitional rules can apply to employment that began before 2004.
Question | KSchG generally applies | KSchG generally does not apply |
|---|---|---|
Length of service | More than six months | Six months or less |
Business size | More than 10 qualifying employees | Ten or fewer qualifying employees |
Legal effect | The dismissal needs a socially justified reason | No general KSchG protection, but other protections remain |
§§ 1 and 23 KSchG: Waiting period and business size
§ 1(1) KSchG sets the waiting period at more than six months. § 23(1) KSchG governs the business-size threshold and weighting of part-time staff.
Probation is not the same as the KSchG waiting period
A probationary period (Probezeit) must be agreed and mainly affects the shorter notice period under § 622(3) BGB. The six-month KSchG waiting period (Wartezeit) applies by law. They often overlap, but they are legally different.
If the KSchG does not apply, you are not without rights. Written form, notice periods, anti-discrimination law, special dismissal protection and consultation of an existing works council may still matter. Dismissals can also breach statutory prohibitions or the principle of good faith. These are fact-specific checks, so the three-week deadline remains important.
What makes a dismissal formally valid?
A valid dismissal must reach you as a paper document bearing an original handwritten signature and must observe the applicable notice rules.
An email, scan, electronic signature or messenger message does not satisfy German law. If someone signs on behalf of the employer, their authority may also need to be examined.
§ 623 BGB: Mandatory written form
Termination of employment by dismissal or separation agreement requires written form; electronic form is excluded.
The statutory basic notice period is four weeks to the 15th or the end of a calendar month. For employer dismissals, it increases after the service periods listed in § 622 BGB.
Your contract or collective agreement may contain different or longer rules. A wrong end date does not have one automatic consequence in every case; the wording and applicable rules must be interpreted.
Ordinary or extraordinary dismissal?
An ordinary dismissal takes effect after the notice period. An extraordinary dismissal, often with immediate effect (fristlose Kündigung), requires an important reason and an individual balancing of interests under § 626 BGB. The three-week court deadline generally applies to both.
Which grounds can justify dismissal under the KSchG?
If the KSchG applies, an ordinary dismissal must be justified by personal, conduct-related or urgent operational reasons. The employer must establish the facts supporting the reason in court; a broad statement such as “restructuring” or “loss of trust” is not enough by itself.
Operational dismissal (betriebsbedingte Kündigung)
The operational decision must eliminate the need for your role, and no reasonable alternative position may be available. If several employees are comparable, the employer must conduct a social selection (Sozialauswahl) based on length of service, age, maintenance obligations and severe disability.
Example: Elena and social selection
Elena has worked in the business for twelve years and supports two children.
A professionally comparable colleague has worked there for one year and has no dependants. If only Elena is dismissed, the social selection should be checked carefully.
Comparability, legitimate retention of key employees and the actual business structure can still affect the result.
Conduct-related dismissal (verhaltensbedingte Kündigung)
This concerns controllable breaches of contractual duties. A relevant prior warning (Abmahnung) is usually required. A warning may be unnecessary if it could not reasonably change future conduct or the breach is so serious that acceptance was obviously excluded.
Personal dismissal (personenbedingte Kündigung)
This does not depend on blame. In illness cases, courts typically examine the future health prognosis, serious operational or financial effects and the final balance of interests. They also ask whether a less severe option could preserve employment.
BEM matters, but it is not an automatic test
If you were unable to work for more than six weeks within one year, the employer must offer workplace integration management (betriebliches Eingliederungsmanagement, BEM) under § 167(2) SGB IX. Missing or defective BEM does not automatically invalidate a dismissal, but it generally makes it harder to show that no less severe option existed.
How can the works council affect your dismissal?
If a works council exists, the employer must consult it properly before every dismissal. A dismissal issued without consultation is invalid under § 102(1) BetrVG. The works council does not decide the case, but procedural errors can become important in court.
If the works council properly objects to an ordinary dismissal and you file a claim, you may request continued employment until the case is finally decided. Statutory exceptions apply. Contact the works council promptly and ask whether it was consulted and whether it issued a written response.
Who has special protection against dismissal?
Pregnant employees, employees on parental leave, severely disabled employees and certain employee representatives benefit from additional protection. Depending on the category, dismissal may require prior authority approval or be permitted only in narrow exceptions.
Situation | Additional protection |
|---|---|
Pregnancy and protected period after birth | Statutory prohibition with authority-approved exceptions |
Parental leave | Protection begins within statutory pre-leave periods and continues during leave |
Severe disability | Prior approval of the Integration Office is generally required; statutory exceptions apply |
Tell your legal adviser immediately about pregnancy, parental leave, disability status or an elected representative role. Under § 17 MuSchG, a pregnancy unknown to the employer when notice was given can, subject to the statutory conditions, still be reported within two weeks after receipt.
What does dismissal mean for your residence permit?
Losing your job does not automatically cancel every residence permit on the same day, but an employment-based permit can trigger a separate duty to notify the immigration authority. Check the wording on your residence card, its supplementary sheet (Zusatzblatt) and the authority’s approval letter. EU/EEA and Swiss citizens, permanent residents, family-based permit holders, EU Blue Card holders and other skilled workers do not all follow the same rules.
Check the two-week immigration deadline
Holders of residence permits under Chapter 2, Sections 3 or 4 of the Residence Act must notify the immigration authority within two weeks of learning that the training or employment for which the permit was issued ended early. The rule appears in § 82(6) AufenthG.
For certain skilled-worker permits, § 18(5) AufenthG provides that a later shortening should generally leave at least six months from the end of employment. This is not a universal “six-month grace period”. The immigration authority must assess the specific permit, and your original expiry date is not extended.
Expat tip: separate the three timelines
Put three dates in your calendar: the Labour Court deadline, the jobseeker-registration deadline and any immigration notification deadline. An HR discussion, severance negotiation or pending court case does not automatically suspend the other timelines.
When can you receive severance pay?
Severance is often negotiated, but it can also arise from a specific statutory or contractual basis. Most payments result from an out-of-court or court settlement. Under § 1a KSchG, a claim can arise after an operational dismissal if the notice contains the statutory offer and you let the three-week claim deadline expire.
§ 1a KSchG: Statutory claim under specific conditions
If the operational dismissal contains the statutory notice and no dismissal protection claim is filed, severance becomes due when the notice period ends. The statute uses 0.5 monthly earnings for each year of employment.
Separation agreement (Aufhebungsvertrag) | Court Settlement (gerichtlicher Vergleich) |
|---|---|
Ends employment by mutual agreement and may waive dismissal rights. | Ends a pending dispute on terms agreed by both sides. |
May trigger an unemployment-benefit blocking period if no important reason is recognised. | Does not automatically eliminate social-security risks; wording and circumstances matter. |
Usually cannot simply be revoked, so do not sign under time pressure. | Can regulate severance, end date, garden leave, reference and outstanding payments. |
Unemployment benefits and blocking periods
A separation agreement can cause a blocking period for voluntarily giving up employment under § 159 SGB III unless an important reason is recognised. Twelve weeks is the standard period for this category, but reductions and exceptions exist. Late jobseeker registration is a separate category and does not automatically produce a twelve-week block.
What should be on your action checklist?
Work through these items in order so that one negotiation does not cause you to miss another deadline.
Dismissal action checklist
Record the date and circumstances of receipt; keep the envelope
Check for a paper original, handwritten signature and stated end date
Calendar the three-week Labour Court deadline
Collect your contract, collective agreement, warnings and pay records
Do not sign a separation or settlement document without review
Register as a jobseeker within three days if fewer than three months remain
Contact the works council and, where relevant, disability representative
Flag pregnancy, parental leave, severe disability or elected office
Check the two-week immigration notification duty for your permit
Request a qualified reference and a clear final payroll statement
How can you request documents in writing?
You can use the following German template to request your end date, final payroll and qualified reference while expressly reserving your rights. It does not replace a dismissal protection claim and does not extend the three-week deadline.
Template letter: request documents after dismissal
[Your First and Last Name]
[Your Address]
[Employer's Name and Address]
[Place, Date]
Subject: Termination dated [Date] / Request for Documents
Dear Sir or Madam,
I received your notice of termination on [date of receipt].
Please confirm in writing the termination date you are applying, and send me a comprehensible final settlement statement. I also request that you issue a qualified reference (qualifiziertes Arbeitszeugnis) in accordance with Section 109 of the German Trade, Commerce and Industry Regulation Act (Gewerbeordnung, § 109 GewO).
If a works council (Betriebsrat) exists at your company, please inform me whether and when it was consulted regarding this termination.
I expressly reserve all rights and objections against the termination.
Yours faithfully,

Is your three-week deadline already running?
Have the letter, receipt date and possible protection grounds assessed before your options narrow.
Digital document submission
Clear explanation in plain language
Representation in negotiations and before the Labour Court where required
Key takeaway
A German dismissal is not valid merely because it looks formal, and you retain practical options if you act within the deadlines. Check the original signature, receipt date, notice period, KSchG coverage, stated or suspected grounds and any special protection. For expats, run employment, benefits and immigration tasks in parallel. The three-week claim deadline is the central time limit; securing it gives you space to make informed decisions rather than rushed ones.
